Understanding UK waste regulations is essential whether you're clearing out your home, running a business, or hiring someone to remove waste on your behalf. The law places specific responsibilities on everyone involved in waste disposal, and failing to comply can result in significant fines.

Your Duty of Care

Under the Environmental Protection Act 1990, you have a legal "duty of care" to ensure your waste is disposed of properly. This means:

  • Only using authorised waste carriers with a valid licence
  • Ensuring waste goes to a licensed facility
  • Keeping records of waste transfers (for businesses)
  • Taking reasonable steps to prevent illegal dumping

Important: If your waste is fly-tipped, YOU can be held responsible and fined up to £50,000 – even if you paid someone else to remove it.

Waste Carrier Licensing

Anyone carrying waste for profit must be registered with the Environment Agency. There are two tiers:

Lower Tier

For businesses carrying their own non-construction waste

Upper Tier

For businesses carrying other people's waste professionally
